September 22, 2004: DC Comics Goes to Court over Kryptonite

The stuff that weakens the Man of Steel is protected by trademark.

A federal judge has ruled that the owner of the Superman franchise, DC Comics, owns a valid trademark in "kryptonite" that can be protected from dilution and infringement by a bicycle lock company that adopted the name.

DC Comics took Kryptonite Corp. to court over a 1990s breach in an agreement drawn up back in 1983 which allowed the bicycle lock manufacturer limited use of the word "kryptonite" in association with the promotion of their bike locks.

DC Comics were successful in their claim.
