January 30, 2013: Another Superman Court Case Hits Sydney, Australia

Superman Workout DC Comics has appealed a decision handed down in the Federal Court in Australia, which allowed a Sydney Fitness company to register to the trademark "Superman Workout".

    Last July, the registrar ruled Cheqout Pty's use of the Superman Workout trademark was not likely to deceive or confuse Australian consumers, nor would it cause a significant number of people to believe there was a connection between the fitness classes and DC Comics' Superman character.

    "One of the errors in the registrar's reasoning is that he looks at the dictionaries and says there's a reference to the Nietzsche meaning and a reference to my client's character and he then proceeds on the basis that the Nietzsche meaning will be well known to the population at large," Ron Webb SC, representing DC Comics, said.

    "We say overwhelmingly when used in this way in respect to these (health and fitness) services, because of our reputation, it will call up my client's character."
