April 6, 2008: Judge Orders DC and Siegel Family to Mediate

The judge presiding over the litigation between DC Comics/Warner Brothers and the estate of Superman co-creator Jerry Siegel issued a new Order on March 31, 2008. The Order requires the parties to spend the next 60 days engaged in good-faith mediation with the independent third party mediator both parties had agreed to (which, in the Order the judge notes, the parties haven't done together since 2004).

The parties are expected to negotiate in good faith in an effort to resolve all issues relating to both the Superman and Superboy litigation. The Order requires the parties to file a Joint Report on June 1, 2008 explaining the results of their mediation and any progress made or resolutions reached. Should the parties not be able to settle the Superman case, the judge scheduled the trial for November 8, 2008 (and he also set certain other dates relevant to trial preparation).

Because certain issues related to the Superboy case may apparently be resolved in the Superman case, the judge has decided not to rule on any motions in that case or schedule any hearings till after the Superman trial ends. A copy of the March 31 Order is available to read here.

UPDATE: Newsarama.com have a great article which helps to explain the mediation process.
