DC Loses Lawsuit Over Superman-Themed Snacks

DC Comics may own the rights to Superman, but the Indonesian legal system has ruled against them in a legal battle with PT Marxing Fam Makmur, a Surabaya-based food and beverage company that holds the intellectual rights to the brand name Superman and its likeness in Indonesia.

Since 1993 Marxing has legally used Superman on snack products including biscuits, ice cream, and chocolate bars, which worked against DC Comics when they tried to register the trademark for Superman in Indonesia. The registration was blocked as Marxing already had an existing trademark for Superman in place.

When DC lost the copyright lawsuit at the Central Jakarta Commercial Court, they appealed to the Supreme Court, which upheld the original ruling stating, “The plaintiff’s lawsuit cannot be accepted because it is obscure”.
